Welcome to Choco Del Mar’s online services. These Terms & Conditions (“Terms”) govern your access to and use of our website, design tools, products, and services (collectively, the “Services”). By creating an account, signing in, or placing an order, you agree to these Terms.

1. Accounts & Access

  • Account Creation: You may create an account using our passwordless sign-in link system (via Firebase). You are responsible for maintaining access to the email address associated with your account.
  • Account Responsibility: You are responsible for all activity conducted under your account. If you suspect unauthorized access, please contact us immediately at [support@chocodelmar.com].

2. Custom Design Services

  • Design Tool: Our site allows you to upload images, add text, and create custom sleeve designs for your chocolate bar orders.
  • Proof Approval: After you place an order, we will send you a PNG proof of your sleeve design.
  • Customer Approval Required: We will not send your order to print until you have reviewed and approved the proof in writing (via email or within our system).
  • Edits: Minor edits can be requested before proof approval. Once approved, no changes or cancellations can be made to the sleeve design.

3. Orders & Fulfillment

  • Minimum Orders: Custom sleeve orders require a minimum quantity as listed on our website.
  • Production Timeline: Production begins only after proof approval and full payment. Estimated timelines will be provided but may vary due to printer or shipping delays.
  • Cancellations & Refunds: Orders canceled before proof approval may be eligible for a refund (less any design or setup fees). Once proofs are approved, orders are non-refundable.
  • Errors: We are not responsible for errors (spelling, image quality, placement, etc.) in proofs you approved.

4. Intellectual Property

  • Your Content: You retain rights to any content you upload. By submitting content, you grant Choco Del Mar a limited license to use, reproduce, and print it solely for fulfilling your order.
  • Restrictions: You may not upload or use content that is unlawful, infringing, offensive, or violates third-party rights.
  • Our Content: All text, graphics, logos, and packaging designs on our website remain the property of Choco Del Mar LLC and may not be copied or used without permission.

5. Pricing & Payment

  • Pricing: Prices are listed in U.S. dollars and are subject to change without notice.
  • Taxes & Shipping: Applicable sales tax and shipping fees will be added at checkout.
  • Payment: Orders must be paid in full before proof generation and production.

6. Shipping & Delivery

  • Risk of Loss: Risk of loss transfers to you upon delivery by the carrier.
  • Delays: We are not liable for shipping delays outside our control (carrier issues, weather, etc.).
  • Temperature-Sensitive Products: Chocolate is temperature-sensitive. Orders may include special packaging or shipping upgrades at our discretion during warm weather.

7. Limitation of Liability

Choco Del Mar is not liable for indirect, incidental, or consequential damages arising from the use of our Services or products. Our maximum liability shall not exceed the amount paid for the specific order at issue.

8. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

9. Updates to Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of our Services constitutes acceptance of the updated Terms.
